These Terms and Conditions set out the basis on which we provide rubbish removal and waste collection services in St Johns Wood and surrounding areas. By booking a service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Service means any rubbish removal, waste collection, bulky waste clearance, house or office clearance, or related service we provide.
1.2 We, us or our means the rubbish removal service provider supplying the Service.
1.3 You or your means the customer, being the person, firm or company who requests and purchases the Service.
1.4 Booking means your request for the Service, whether made by telephone, email, online form or any other agreed method.
1.5 Site means the property, premises or location where the Service is to be carried out.
1.6 Waste means the items, materials and rubbish that you ask us to remove as part of the Service.
2. Scope of Service
2.1 We provide rubbish removal and waste collection services to domestic, commercial and other clients in St Johns Wood and nearby areas, subject to availability, access and compliance with applicable waste regulations.
2.2 The exact scope of the Service, including the volume or weight of Waste to be removed, the number of operatives and vehicles, and the estimated time on Site, will be agreed with you at or before the time of Booking. Any description of the Service not forming part of a formal quotation or order confirmation is for guidance only.
2.3 We reserve the right to refuse to remove any Waste which we reasonably believe may be hazardous, illegal, contaminated, unsafe to handle, or not accurately described at the time of Booking or upon our arrival at the Site.
3. Booking Process
3.1 You may request a Booking by telephone, email or through our online enquiry process, providing full and accurate details of the Waste, including type, approximate volume, location within the property, and any access issues or parking restrictions.
3.2 Any quotation we provide, whether verbal or written, is based on the information you supply. If upon arrival the Waste is substantially different in type, quantity or location, or access is more restricted than advised, we may amend the quotation, charge additional fees, or decline to carry out all or part of the Service.
3.3 A Booking is only confirmed when we confirm acceptance to you, allocate a time slot or date, and you accept any applicable charges or pre-payment terms. We may refuse any Booking at our discretion.
3.4 We will use reasonable efforts to attend the Site on the agreed date and within the quoted time window. However, any times given are estimates only and may vary due to traffic, previous jobs or other circumstances beyond our control.
4. Access and Parking
4.1 You are responsible for ensuring that adequate access and parking are available at the Site for our vehicles and operatives to carry out the Service safely and efficiently.
4.2 If parking permits, visitor passes or special authorisations are required, you must arrange these in advance and bear any associated costs. Where this is not possible, you must inform us prior to the Booking so that alternative arrangements may be considered.
4.3 If we incur parking charges, congestion charges or penalty tickets directly as a result of carrying out the Service in accordance with your instructions, these costs may be added to your invoice.
5. Customer Obligations
5.1 You warrant that you are either the owner of the property and the Waste, or you have full authority from the owner to arrange for the Waste to be removed and disposed of.
5.2 You must ensure that:
a. the Waste to be removed is clearly identified and separated from any items not intended for removal;
b. there is a responsible adult present at the Site during the Service, unless previously agreed otherwise;
c. the Site is safe and there are no known health or safety risks that have not been disclosed to us in advance.
5.3 You must not include within the Waste any items which we have stated we cannot accept, including hazardous substances, clinical waste, asbestos, gas cylinders, explosives, or any item prohibited by law or by our waste carrier licence.
6. Payments and Charges
6.1 Charges for the Service are typically based on the volume or weight of Waste removed, the nature of the materials, the labour involved and any additional services required, such as dismantling, lifting or extra loading time.
6.2 We will either provide a fixed price, a price range, or a tariff-based estimate prior to attending the Site. Where only an estimate is given, the final price will be confirmed once we have assessed the Waste in person.
6.3 Unless otherwise agreed, payment is due at the time the Service is completed, and must be made by cash, debit card, credit card or other methods we expressly accept. We may require partial or full pre-payment for certain bookings.
6.4 All prices are quoted inclusive or exclusive of VAT depending on the status we have notified you. Any applicable taxes will be clearly stated on your invoice.
6.5 If payment is not made when due, we reserve the right to charge interest on overdue sums at the statutory rate, and to recover any reasonable costs incurred in obtaining payment.
7. Cancellations, Rescheduling and Delays
7.1 You may cancel or reschedule a Booking by giving us reasonable notice. Where possible, you should give at least 24 hours notice prior to the agreed arrival time.
7.2 If you cancel or reschedule with less than 24 hours notice, or if we arrive at the Site and are unable to gain access or perform the Service for reasons within your control, we may apply a cancellation or call-out fee to cover our costs.
7.3 We may cancel or reschedule the Service where necessary due to adverse weather, vehicle breakdown, staff illness, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will seek to agree a new date and time with you as soon as reasonably practicable.
7.4 We shall not be liable for any loss, damage or expense you may suffer as a result of cancellation or delay due to events outside our reasonable control.
8. Waste Handling and Regulations
8.1 We operate in accordance with applicable UK waste management laws and regulations. We are committed to lawful, responsible and environmentally conscious handling, transport and disposal of the Waste we collect.
8.2 Once the Waste has been loaded into our vehicle and payment has been made or agreed, ownership of the Waste transfers to us, subject to any statutory rights or obligations.
8.3 We will determine the most appropriate method of treatment or disposal, which may include reuse, recycling, recovery, or landfill. We do not guarantee that any particular proportion of Waste will be recycled or reused, although we will use reasonable efforts to minimise landfill where feasible.
8.4 In the event that you have misdescribed the Waste, or included prohibited or hazardous items without our prior written consent, you may be held responsible for any additional costs, fines, penalties or liabilities we incur as a result.
9. Liability and Limitations
9.1 We will exercise reasonable care and skill in providing the Service. However, you acknowledge that the nature of rubbish removal and waste collection can involve movement of bulky or awkward items, and may present some risk of minor damage to surrounding areas.
9.2 You must take reasonable steps to protect any areas of the Site that may be vulnerable to damage, including walls, floors, doors, fixtures and fittings. We are not liable for normal wear and tear or superficial damage that could reasonably occur when removing large or heavy items in confined spaces.
9.3 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by law.
9.4 Subject to clause 9.3, our total liability to you arising out of or in connection with the Service, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable for the specific Service giving rise to the claim.
9.5 We shall not be liable for any loss of profit, loss of business, loss of opportunity, loss of goodwill, or any indirect or consequential loss suffered by you as a result of our provision of, or failure to provide, the Service.
10. Damage, Complaints and Claims
10.1 You must notify us as soon as reasonably practicable if you believe that any damage has been caused to your property in the course of us providing the Service.
10.2 All complaints or claims must be submitted to us in writing, with reasonable details and supporting evidence, within a reasonable time of the issue arising, and in any event no later than 7 days from completion of the Service.
10.3 We may request access to inspect the alleged damage, and you must give us a reasonable opportunity to do so before any repairs or remedial works are carried out, except in an emergency.
10.4 If we accept responsibility for damage, we shall at our option repair the damage, pay for a third party to repair the damage, or pay you a fair and reasonable sum reflecting the cost of repair or replacement, subject to the limitations set out in these Terms and Conditions.
11. Insurance
11.1 We shall maintain appropriate public liability insurance and, where applicable, employer liability insurance for the purposes of our rubbish removal activities.
11.2 Evidence of our insurance cover is available on request. Our insurance does not cover items that you have not clearly identified as Waste for removal or areas of the property outside the reasonable scope of the Service.
12. Data Protection and Privacy
12.1 We will collect and process personal data about you to manage your Booking, provide the Service, process payments, and handle any enquiries or complaints.
12.2 We will handle your personal data in accordance with applicable UK data protection legislation. We will not sell your personal data to third parties, and will only share it where necessary to perform the Service, comply with legal obligations, or with your consent.
13. Termination of Service
13.1 We may suspend or terminate the Service immediately if:
a. you fail to make payment when due;
b. you breach any material term of these Terms and Conditions;
c. it becomes unsafe or unlawful to continue with the Service; or
d. we are instructed to do so by any relevant authority.
13.2 Termination does not affect any rights, remedies, obligations or liabilities that have accrued up to the date of termination.
14. Variations to Terms
14.1 We reserve the right to amend these Terms and Conditions from time to time. Any updated version will apply to new Bookings from the date on which it is made available.
14.2 The Terms and Conditions in force at the time of your Booking will generally govern that Booking and related Service, unless a change in law or regulation requires us to apply revised terms.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, including any non-contractual disputes or claims.
16. General Provisions
16.1 If any provision or part-provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, lawful and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted without affecting the validity and enforceability of the remainder.
16.2 No failure or delay by us in exercising any right or remedy provided by law or under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
16.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract any of our rights or obligations where this does not reduce the level of protection given to you under these Terms and Conditions.
16.4 These Terms and Conditions constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings, arrangements or agreements, whether written or oral.
16.5 By placing a Booking for rubbish removal or waste collection with us in St Johns Wood or surrounding areas, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
